2 June 2025Acquittal in an Embezzlement Case – A Win for Adesman & Asociații
Favourable outcome in a complex embezzlement case
The Adesman & Asociații legal team secured an acquittal in a complex criminal case with cross-border elements, in which the management board of a major Romanian aerospace company had been accused of embezzlement.
This high-profile case began with a criminal complaint filed by the company's majority shareholder – a subsidiary of a United States corporation – with the aim of removing the company's management.
Charges refuted: the Adesman & Asociații strategy
The criminal complaint arose from an internal dispute: the management board had refused a request to lay off a large number of employees during the pandemic caused by COVID-19.
The main charges included the allegedly unlawful award of bonuses, said to have been concealed through supposedly covert actions.
The Adesman & Asociații team demonstrated that:
- The bonuses awarded were fully compliant with the management board's powers;
- They had been approved as part of the company's annual budget;
- The amounts were allocated on the same terms as in previous years, with no departure from internal procedures.
The court's decision: acquittal
The court was persuaded by the strong arguments presented by the Adesman & Asociații team, made up of Diana Adesman, Managing Partner, and Ciprian Nicu, Partner.
The judgment held that the acts alleged did not constitute embezzlement, and the charges were dismissed as unfounded.
What this outcome means for businesses
This decision sets an important precedent for protecting the rights of management boards and companies against legal abuse. It clarifies how the statutory provisions on embezzlement should be interpreted and highlights the importance of a well-argued defence strategy.
